Regular Meeting Minutes –September 20, 2023
The Churubusco Town Council met on September 20, 2023 at 6:00 p.m. in the Scout Building. Members present were council members Devin Keener, Mark Pepple, and Nathan Van Horn; and Clerk-Treasurer, Madalyn Sade-Bartl. Others present were residents Lisa Fensler, Brian Clark, and Brandon Rittenhouse; Zach Zehner, Carson LLP; and Park Director, Rick Krider
President Keener called the meeting to order, welcomed visitors, and led the Pledge of Allegiance. The Clerk called roll. All members were present.
Approval of Meeting Minutes: August 2, 2023 and August 15, 2023
Mr. Van Horn made a motion to approve August 2, 2023 meeting minutes. President Keener seconded, and the motion carried 3-0. Mr. Van Horn made a motion to approve August 15, 2023 meeting minutes. President Keener seconded, and the motion carried 2-0 with Mr. Pepple abstaining.

Approval of Claims:
Claims Vouchers dated September 6, 2023 in the amount of $443,351.58 and September 20, 2023 in the amount of $38,531.00 were presented and approved.
Public Comment:
There were no public comments.
Old Business:
There was no old business.
New Business:
1. First Reading- Ordinance 2023-07: Additional Appropriations: Ms. Bartl explained the need for additional appropriations to be added to the General fund and the General Obligation Construction fund. Mr. Van Horn made a motion to introduce Ordinance 2023-07. Mr. Pepple seconded, and the motion carried 3-0. Ms. Bartl stated a public hearing would be held at the October 4, 2023 meeting.

2. Resolution 2023-08: Reduction of Appropriations: Ms. Bartl stated that in order for the 2024 budget to be approved, the 2023 budget for Rainy Day needed to be reduced. Mr. Van Horn made a motion to approve Ordinance 2023-08. Mr. Pepple seconded, and the motion carried 3-0.

3. First Reading- Ordinance 2023-09: 2024 Budget: Mr. Van Horn made a motion to introduce Ordinance 2023-09. Mr. Pepple seconded, and the motion carried 3-0. Ms. Bartl stated a public hearing would be held at the October 4, 2023 meeting.

4. First Reading- Ordinance 2023-10: Ordinance Adopting a Policy to Close a Public Thoroughfare by a Private Entity: Mr. Zehner discussed the proposed policy and stated there were a variety of reasons why it is important to establish a policy. There was discussion concerning aspects of the policy and procedure including changes the Council would like to see made. Mr. Pepple made a motion to introduce the ordinance with the proposed changes. Mr. Van Horn seconded, and the motion carried 3-0. Ms. Bartl stated a public hearing would be held at the October 18, 2023 meeting.

5. First Reading- Ordinance 2023-11: Ordinance Amending the Town’s Wastewater Use Policy: Mr. Zehner explained the changes that were made to the ordinance. Mr. Pepple made a motion to introduce Ordinance 2023-10. Mr. Van Horn seconded, and the motion carried 3-0.
6. Consideration of change of employee pay classification- Tadd Shively: Ms. Bartl stated that when Mr. Shively was hired, it had been discussed that he would be moved from Pay Class 2 to Pay Class 1 after his probationary period had expired. She stated the period had ended and she was suggesting the Town made good on that promise by moving him to Pay Class 1 effective the beginning of the current pay period (September 18, 2023). Mr. Pepple made a motion to approve the pay classification change. Mr. Van Horn seconded, and the motion carried 3-0.

7. Approval of Work Change Directives 2: Ms. Bartl explained the directive. Mr. Van Horn made a motion to approve the work change directive. Mr. Pepple seconded, and the motion carried 3-0.
Department Reports:
Jeremy Hart, Town Supervisor:
Mr. Hart was not present but left the attached report.
Bob Gray, Wastewater Treatment Plant Supervisor:
Mr. Gray was not present.
Dustin Papenbrock, Town Marshall:
Mr. Papenbrock was not present.
Rick Krider, Park Superintendent:
Mr. Krider stated they were beginning to mulch the trails. He was also happy to report the Splash Pad had been fully operational all season.
Andy Boxberger, Town Attorney:
Mr. Boxberger was not present. Zach Zehner had nothing fully to report.
Council Reports:
Mark Pepple:
Mr. Pepple stated he and Ms. Bartl had attended the Drainage Board meeting on Monday. The County was finally investigating how to fix the Rapp ditch and they were contemplating an increase in assessments.
Devin Keener:
President Keener had nothing to report.
Nathan Van Horn:
Mr. Van Horn wanted the Council to implement broadcasting on Facebook Live. Ms. Bartl stated the meetings needed to be moved back to the Town Hall so the equipment could stay up. The Council was ok with moving the meetings back to the Town Hall. Ms. Bartl stated she would explore installing cameras and microphones in the Town Hall.

Ms. Sade-Bartl presented the attached report.
Having no other business and after all proper papers were signed, President Keener adjourned the regular meeting.
