AN ORDINANCE ESTABLISHING THE TOWN OF CHURUBUSCO, INDIANA ECONOMIC DEVELOPMENT COMMISSION
WHEREAS, the Town of Churubusco (the “Town”) is authorized to establish the department of economic development to be controlled by the Churubusco Economic Development Commission (“EDC”) by Indiana Code 36-7-12 et seq. to (1) facilitate the financing of single, identified economic development or pollution control facilities and (2) provide a program to finance multiple, unidentified economic development or pollution control facilities that promote a substantial likelihood of creating or retaining opportunities for gainful employment, creating business opportunities, providing reliable water services, the abatement, reduction or prevention of pollution, or the removal or treatment of substances in materials being processed that otherwise would cause pollution when used; and
WHEREAS, the Town Council now finds it is in the best interest of the Town, and its citizens to establish the EDC; and
WHEREAS, the EDC shall exist and operate pursuant to the provision of the Indiana Code 36-7-12 et seq.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF CHURUBUSCO, INDIANA:
Section 1. Creation. The Town does hereby create a department of development of the Town, which shall be under the control of a commission to be known as the “Churubusco Economic Development Commission”, pursuant to and under the authority of Indiana Code 36-7-12 et seq.
Section 2. Appointment and Powers. The EDC shall consist of three members to be appointed as provided by law and shall have all the rights, powers and duties set forth under Indiana Code 36-7-12 et seq.
Section 3. Severability. If any section, paragraph or provision of this ordinance shall be held to be invalid or unenforceable for any reason, the invalidity or unenforceability of such section, paragraph or provision shall not affect any of the remaining provisions of this ordinance.
Section 4. Effective Date. This ordinance shall be in full force and effect immediately upon passage.
