NOTICE OF PUBLIC HEARING ON RESTRICTING THE USE OF SKATEBOARDS IN AREAS WITHIN THE TOWN OF CHURUBUSCO, INDIANA

 

Property owners and interested parties in the Town of Churubusco, Indiana, are hereby notified that Ordinance No. 2017-11, An Ordinance Restricting the use of Skateboards in Areas within the Town of Churubusco, will be open for public comment at a meeting of the Town Council held at 6:30 p.m., local time, on September 6, 2017 at the Churubusco Town Hall, 215 Home Ave., Churubusco, IN with a vote on the ordinance to follow.

 

At such public hearing and prior to final adoption of Ordinance No. 2017-11, all interested parties may appear and be heard.  The complete text of proposed Ordinance No. 2017-11 is on file and available for examination and copying at the office of the Town’s Clerk-Treasurer at 530 S. Main Street, Churubusco, Indiana, during regular business hours, and will be available at the public hearing.

ORDINANCE 2017-11

 

AN ORDINANCE RESTRICTING THE USE OF SKATEBOARDS IN AREAS WITHIN THE TOWN LIMITS OF CHURUBUSCO

 

WHEREAS, the Town of Churubusco has had issues and complaints of skateboards being used on public and private property; and,

WHEREAS, the Town of Churubusco has spent a considerable amount of money revitalizing the downtown business district; and,

WHEREAS, skateboards have been found to damage public and private property; and,

WHEREAS, there is a public skate park located at the Churubusco Community Park which can be utilized for skateboarders within our community.

NOW, THEREFORE BE IT RESOLVED by the Town Council of the Town of Churubusco, operation of skateboards, roller skates, or roller blades shall be restricted to the following:

(1)      Restricted public properties: The use of any public, private or commercial property for skate­boarding, roller blading or roller skating within the downtown business district shall be prohibited. The downtown business district shall include the following:

  • Main Street from Mill Street to Liberty Street
  • Mill Street from Washington Street to Main Street
  • Whitley Street from Mulberry Street to Windsor Drive
  • Mulberry Street from Pleasant Street to Tulley Street
  • Washington Street from Eagle Drive to Line Street
  • Tulley Street from Eagle Drive to Line Street

(2)      Posted property: The use of any public, private or commercial property for skate­boarding, roller blading or roller skating where the owner or lessee of the premises has posted a sign prohibiting such activities and where the property owner or lessee has executed a contract pursuant to IC 9-21-18, authorizing enforcement of this section on the property, shall be prohibited.

(3)      Interference with traffic. No person shall operate, or permit to be operated, any skateboard, roller blades or roller skates within the town, in a reckless or hazardous fashion or in a manner creating interference with pedestrian or vehicular traffic.

(4)      Creating danger to operator or persons nearby. No person shall operate, or permit to be operated, any skateboard, roller blades or roller skates within the town in a manner creating a danger to the operator, or persons nearby.

(A) Penalty for violation of section 1-4,

(1)        Any person violating the provisions of sections 1-4 shall be subject to a fine of $100.00.

(2)        The parent of any child, guardian of any ward, or any other person standing in loco parentis to any child, shall not authorize or knowingly permit any such child or ward to violate any of the provisions of this chapter and shall be held responsible for any violations of this chapter.
