NOTICE OF PUBLIC HEARING ON PROPOSED ORDINANCE AND PENALTIES FOR THE TOWN OF CHURUBUSCO, INDIANA

Property owners and other interested parties in the Town of Churubusco, Indiana are hereby notified that Ordinance No. 2023-10, implementing a policy to close public thoroughfares by private entities, was introduced at a meeting of the Town Council held on September 20, 2023. A public hearing of the Town Council will be held at 6:00 p.m., local time, on October 18, 2023 at the Churubusco Town Hall, 215 Home Avenue, Churubusco, Indiana, on the matter of the additional appropriations. Immediately following the public hearing the Town Council will convene and may consider the adoption of said ordinance.
At such public hearing and prior to final adoption of Ordinance No. 2023-10, all interested parties may appear and be heard. The complete text of proposed Ordinance No. 2023-10 is on file and available for examination and copying at the office of the Town’s Clerk-Treasurer at 204 N. Line Street, Churubusco, Indiana, during regular business hours, and will be available at the public hearing.

Ordinance No. 2023-10
An ordinance adopting the policy of the Town of Churubusco, Indiana as concerns the temporary closure of one or more public thoroughfares and related permitting, and providing penalties for violation thereof.

BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF CHURUBUSCO, as follows:
1. GENERAL. It shall be unlawful for any person to temporarily close a public thoroughfare without a duly authorized Road Closure Permit.

2. PERMIT. The Town Council may establish and adopt a permitting procedure for the temporarily closure of a public thoroughfares, as it deems appropriate and in the best interest of the peace, health, safety, and general welfare of the population.

3. POLICY. The Town Council hereby adopts the policy for road closure as substantially set forth in Exhibit A attached hereto and incorporated by reference (“Policy”).

4. PENALTY. Any person found violating this Ordinance shall have committed an infraction and be subject to a fine as set forth:

First Violation $100/day
Second Violation $250/day
Third Violation $500/day
Fourth/Subsequent Violations $1000/day

5. CONFLICT. All ordinances or parts of ordinances in conflict herewith are hereby repealed.

6. FORCE AND EFFECT. This Ordinance shall be in full force and effect from and after its adoption by the Town Council for the Town of Churubusco, Indiana.
