Regular Meeting Minutes –December 6, 2023
The Churubusco Town Council met on December 6, 2023 at 6:00 p.m. in the Town Hall. Members present were council members Devin Keener, Mark Pepple, and Nathan Van Horn; and Clerk-Treasurer, Madalyn Sade-Bartl. Others present were residents Lisa Fensler, Dan & Monica Millikan, Wayne Yager, and Brian Clark.
President Keener called the meeting to order, welcomed visitors, and led the Pledge of Allegiance. The Clerk called roll. All members were present.
PUBLIC HEARING: Ordinance 2023-15: Additional Appropriations: President Keener opened the public hearing for Ordinance 2023-15. Ms. Bartl gave a summary of the need for the additions. Hearing no public comments, Mr. Keener closed the public hearing.

Approval of Minutes- November 15, 2023
Mr. Van Horn made a motion to approve the minutes for November 15, 2023 as presented. President Keener seconded, and the motion carried 2-0 with Mr. Pepple abstaining.

Approval of Claims:
Claims Vouchers dated December 6, 2023 in the amount of $155,667.82 were presented and approved.
Public Comment:
Dan Millikan approached the Council concerning the passage of Ordinance 2023-11: An Amended and Restated Use Policy that was passed in October. Mr. Millikan stated he had contacted several entities including the Board of Health, IURC, Blue Lake Conservancy District, and his attorney concerning grinder pump ownership being transferred to him. He had a list of questions and had several items of which he was seeking more information. The Council stated they would consult their attorney and collect the information he was seeking, and they would be in touch with him,
Wayne Yager addressed the Council and asked when a barrel would be removed and when restoration would be complete for damage done to his property when Direct Line hit his water line. Ms. Bartl stated she would coordinate with Mr. Hart and get those items rectified.
Old Business:
1. Second Reading of Ordinance 2023-15: Additional Appropriations: Mr. Van Horn made a motion to approve Ordinance 2023-15 as presented. Mr. Pepple seconded, and the motion passed 3-0.
New Business:
1. Water Meter Installation Contract- Bid Extension: Ms. Bartl explained there had only been one contractor who picked up a bid package and they did not pick that up until Monday and did not turn in anything. Holly Miller from DLZ suggested the bidding period be extended to December 20 in hopes a proposal would be received. Mr. Pepple made a motion to extend the bidding period to December 20. Mr. Van Horn seconded, and the motion carried 3-0.
2. Pay Application & Change Order #3: Ms. Bartl explained the change order that was submitted by Crosby. Mr. Pepple made a motion to approve Change Order #3 for the Sewer Plant project. Mr. Van Horn seconded, and the motion carried 3-0. Mr. Pepple stated he reviewed the pay application from Crosby and made a motion to approve the application. Mr. Van Horn seconded, and the motion carried 3-0.
Department Reports:
Jeremy Hart, Town Supervisor:
Mr. Hart was not present, but left the attached report.
Bob Gray, Wastewater Treatment Plant Supervisor:
Mr. Gray was not present.
Dustin Papenbrock, Town Marshall:
Mr. Papenbrock was not present.
Rick Krider, Park Superintendent:
Mr. Krider was not present.
Andy Boxberger, Town Attorney:
Mr. Boxberger was not present.
Council Reports:
Mark Pepple:
Mr. Pepple stated he would not be present at the December 20 meeting.
Devin Keener:
President Keener had nothing to report.
Nathan Van Horn:
Mr. Van Horn stated he had called Pat Esslinger at the Legion and was going to set up a time to discuss the Hometown Hero banners.
Madalyn Sade-Bartl:
Ms. Sade-Bartl presented the attached report.
Having no other business and after all proper papers were signed, President Keener adjourned the regular meeting.
